Dana Augustine focuses her practice on medical malpractice, product liability, and Civil Rights matters for catastrophically injured clients. Dana is a passionate advocate for the clients that she represents and takes great pride in helping those in need. She loves the challenge of a difficult case, and she has secured multi-million dollar settlement awards on behalf of clients whose cases had been rejected by multiple other attorneys.

Dana initially started her practice defending corporations. A first-generation professional from a small steel town outside of Pittsburgh, she went on to become a partner at a prominent Philadelphia law firm where she defended corporations-usually large product manufacturing or construction companies. She would visit factories to observe the manufacturing process, inspect scenes to learn about the product use and application, and work with the company employees and experts in the field to obtain a technical understanding of the product involved in complex product cases. In defending construction companies, she studied the regulations governing her clients' industry and followed workers on the job site to learn her clients' business. As a result of her relentless preparation, Dana won or favorably resolved many cases requiring the defense of a complicated product, against allegations of manufacturing and design defects. She obtained dismissals and favorable settlements in many suits against contractors involved in construction accidents.

In the course of her career as a defense attorney, Dana also represented schools and social services agencies in highly sensitive cases. The injured plaintiff was often a minor alleging negligent supervision, intentional violence, or emotional bullying resulting in devastating injuries.

Dana came to realize over the years-particularly after starting her own family-that the professional satisfaction on the defense side was fading in light of her personal convictions. Knowing that she wanted to help injured plaintiffs and their families, rather than insurance companies and their insureds, she became a plaintiffs’ advocate several years ago. She has found that the experience she gained defending product manufacturers and other corporations is invaluable to her current practice.

    Significant Cases
    Dana agreed to take a case and served as lead counsel for an injured factory worker who believed that a machine in the factory was defective but had been turned away by many firms. After filing suit against the machine manufacturer, working with multiple experts, participating in inspections of the machine on the factory floor, and deposing over a dozen witnesses including current and former employees of the defendant manufacturer, Dana secured a $3-million dollar settlement for that client against a manufacturer who had been an industry leader for decades.

    In another matter, Dana agreed to take on a case on behalf of a prison inmate who was denied medical care while incarcerated which lead to a delay in the diagnosis of cancer and a delay in treatment. This client’s case had also been rejected by several Philadelphia law firms. Dana filed suit on the grounds of medical negligence and a denial of the inmate’s Constitutional rights. After serving as lead counsel on that matter and deposing over 30 persons including prison wardens, doctors, nurses, and the correctional officers assigned to the client’s housing unit in the prison, Dana’s client obtained a 7-figure confidential settlement.
