Types of Accidental Injuries

Depending on the severity of the accident, the resulting injury can be anywhere from a minor cut or bruise to death. Some injuries may not immediately appear after the accident and manifest hours, days, or weeks later.

Common types of accidental injuries are:

  • Contusions – Small or large bruises often form after a hard impact in a motor vehicle or slip and fall accident, leaving the body sore and tender.

  • Brain injuries – From a mild concussion to a severe traumatic brain injury, hitting your head during an accident can lead to cognitive impairment.
  • Spinal cord injuries – Drastic accidents can result in a spinal cord injury, which carries a risk of permanent disability or premature mortality.

What to Do After an Accidental Injury

After an accidental injury, take the correct steps to ensure your rights are protected.

Maintain Documentation

Document as much as possible in connection with your accident, including:

  • Photographs and videos from the scene, if possible
  • Photographs and videos of any injuries incurred from the accident
  • Photographs and videos evidence of any property damage associated with the accident
  • Keep your shoes and clothing from the accident
  • Maintain a journal of what you recall from the accident as well as any resulting physical pain and mental anguish that follows
  • A copy of the incident report or police report filed for your accident
  • Handwritten notes, email copies, or transcripts from any communications with a third party associated with the accident, including interactions with the other party involved, law enforcement, witnesses, medical professionals, and insurance agents.
  • Receipts for any expenses related to the accidental injury
  • Documentation of lost wages incurred as a result of the injury

Don’t worry if you can’t obtain all of that information. We can track it down for you.

Report the Accident

Report the accident to create an official record of the injury, whether with local law enforcement or with the property or business owner where the accident occurred.

Do not discuss fault while reporting the accident or discuss too many details without including your personal injury attorney in the conversation.

Do Not Sign Anything or Accept Any Blame

If your accident occurred on someone else’s property or business, the owner may attempt to persuade you to dismiss their liability. Make sure not to sign anything or admit any responsibility for your accident.

Seek and Follow Medical Advice

Promptly seek medical advice after your accidental injury. Your health is a top priority, and not all injuries will appear immediately after your accident. Some accidental injuries may not show visible signs, and others may only appear hours, days, or weeks later.

Follow all medical advice and treatment plans given to you by your medical professional, and keep documentation of all your medical consultations.

Track Expenses

Keep track of all expenses that result from your accident. Examples of applicable expenses are medical bills, property damage, and lost wages.

A well-versed personal injury attorney will help you and your loved ones navigate this trying time while protecting your rights and fighting to recover compensation for all your damages.

Accidental injuries in the United States

Accidental injuries in the United States, unfortunately, often result in a fatality.  One recent year had an estimated 227,000 fatalities from unintentional injuries, according to the Centers for Disease Control and Prevention (CDC).

Unintentional, or accidental, injuries were the leading cause of death in the United States in one recent year for people younger than 44, according to data compiled by the (CDC)

Accidental injuries were the fourth leading cause of death for infants under one year of age. For those ages 45 to 64, unintentional injuries were the third leading cause of death. This type of injury was the seventh leading cause of death for those 65 and older.

Fortunately, not all accidental injuries result in fatalities.  However, many severe accidental injuries result in an emergency room visit. Nearly 24.5 million emergency room visits in one recent year were due to nonfatal accidental injuries

Motor vehicle accidents often result in detrimental injuries and fatalities.

According to the Insurance Institute for Highway Safety (IIHS), an estimated 42,500 fatalities from motor vehicle accidents resulted in one recent year. More than half of the total fatalities were due to single-vehicle accidents.

Of the 42,500 deaths, an estimated 6,000 were motorcyclist fatalities, 7,500 were pedestrian fatalities, and 1,000 were bicyclist fatalities.

A total of 685 motor vehicle fatalities occurred in New Jersey, 1,175 happened in New York, and 1,179 took place in Pennsylvania.

Dealing With the Insurance Company

To receive compensation for your accidental injury, you must file a claim with an insurance company. This lengthy and complicated process can leave many people feeling overwhelmed, confused, and frustrated.

The insurance company will try to reduce the compensation it pays. It may attempt to use your words and statements to your disadvantage.

You need a trusted and distinguished personal injury attorney to help you with your claim so you do not fall prey to common insurance company tactics.

A skilled personal injury attorney will:

  • Manage the claims process – Your attorney will handle the entire claims process for you, including filing the initial claim, managing all correspondence with the insurance adjuster, negotiating the settlement offer, filing a lawsuit (if necessary), and representing and advocating for you throughout the entire process.
  • Keep you apprised of updates – A dependable personal injury attorney will keep you in the loop throughout your claims process, keeping you thoroughly informed of where your claim stands.
  • Prove fault – An assertive attorney will fight your claim to ensure your accident’s fault clearly lies with those parties responsible and not with the victim.
  • Recover compensation for all costs – A loyal personal injury attorney will recover compensation for all costs associated with your accidental injury, including physical pain, emotional suffering, property damage, medical expenses, and lost wages.
