Franklin R. Strokoff, Esq. of The Rothenberg Law Firm LLP, obtained a $1.75 million verdict on May 21, 2014 at a Bergen County trial for a car accident victim, in Dufalo v. Yildirim Alkis and New Jersey Manufacturers Insurance Company.
Mr. Strokoff’s verdict was on behalf of Ms. Dufalo, a 68 year old injured in the car accident. Ms. Dufalo underwent an open surgery to repair a torn rotator cuff and labrum. She also suffered a cervical spine injury. Ms. Dufalo’s doctors testified that her injuries caused her permanent right shoulder, neck and right arm pain, along with pain and weakness in her right hand following the accident.
The Rothenberg Law Firm LLP’s lawsuit included an Underinsured Motorist Coverage claim (UIM). The defendant, Alkis, settled before trial and did not have sufficient liability insurance coverage to fully compensate Ms. Dufalo for her significant personal injuries. Therefore, the lawsuit pursued additional compensation for Ms. Dufalo from her own UIM coverage with New Jersey Manufacturers Insurance Company (NJM). Prior to trial, The Rothenberg Law Firm LLP warned NJM that it will seek post-verdict “bad faith” damages against NJM as a result of its willful refusal to tender its UIM policy. After the four day trial, the Bergen County, New Jersey jury awarded her $1.75 Million.
