On February 4, 2014, Minor Plaintiff, approximately 14 months old, was one of two toddlers at the Precious Playful Smiles Daycare. After being taken out of a high-chair by the only present child care aide, Minor Plaintiff walked independently about the room while the child care aide tended to the other toddler. According to court documents, while unsupervised, Minor Plaintiff walked over to a low ledge where a child’s aide left a coffee cup unattended. Minor Plaintiff lifted the coffee and spilled it upon his upper chest down to above his genitals. Minor Plaintiff was transported by EMS to St. Christopher’s Hospital for Children’s emergency department. He was found to have a scald burn injury to his face/chest/abdomen and left arm, covering 6 % of his total body surface area. He was treated and admitted for inpatient management to the special care unit. The next day, Minor Plaintiff was reevaluated and assessed to have second degree burns. His wounds were debrided and he was discharged. As a result of the incident, a plastic surgeon opined that Minor Plaintiff sustained permanent scars of the chest, abdomen and left arm (See D.B., a minor v.
